All nursery stock is sold "as is". We hereby disclaim and
exclude all warranties express or implied, in fact or by law,
including without limitations any warranties of
merchantability or fitness for intended use or particular use.

THIS WARRANTY IS PART OF ALL SALES
AGREEMENT AND ITS ACCEPTANCE IS A
NECESSARY CONDITION OF SALE.
LIMITATION OF LIABILITY

Seller's maximum liability whether contractual, due to
negligence or for any other reason shall be limited to the
amount the buyer paid to the seller for purchase of nursery
stock or any other material under all circumstanced and
regardless of the nature, cause or extent of the loss. Under NO
circumstance will the seller be LIABLE to the buyer for
consequential damages.

SEVERABILITY

In the event that any part of these terms and conditions of sale
is held to be illegal or unenforceable in any jurisdiction, the
other parts shall nonetheless remain in full force and effect.
